General Terms and Conditions of Sale

Terms governing your use of the TOEIC and TOEFL preparation services

1. Purpose

These GTCS set out the terms of the contractual relationship between Erosophia.eu and you, as the client, when subscribing to one of the TOEIC and TOEFL preparation offers available on this platform. By accepting them, you agree to comply with them.

2. Company Presentation

Erosophia.eu is a micro-enterprise based in Normandy, France. Educational content and support are provided in French and/or English.

3. Offers

Erosophia.eu offers various preparation programs (TOEIC 4-Skills, TOEIC Listening & Reading, TOEFL iBT) providing access to educational content and training tools.

The use of the Services is subject to an obligation of means; it does in no way constitute a guarantee of success in an exam or the obtaining of a specific score, which depends on the Client's personal work.

Subscriptions are available on a weekly, monthly, quarterly, or annual basis. The contract is concluded for the duration of the chosen plan and expires automatically unless renewed.

The content of these programs may be modified, expanded, or removed to adapt to changes in official exams. In the event of any changes, a 60-day notice will be provided to you.

If your subscription is directly affected:

  • You will retain access to your current offer until the end of the already-paid period
  • You will have the option to terminate your subscription to avoid automatic renewal
  • If you do not cancel, your subscription will be automatically renewed under the new applicable conditions at the end of your current period

4. Payment

The subscription fee is due upon enrollment for the initial chosen period, and is then automatically charged on each renewal date. Stripe records and access logs shall serve as proof of transactions between the parties.

If the Client has a discount code, it must be entered in the "Add a promotional code" field before validating the payment.

Payment is made exclusively by credit card. The Client must provide their banking details, with the transaction secured and processed via the Stripe provider.

At each renewal, the bank account provided at the time of subscription is automatically debited 24 hours before the renewal date. After each payment, an invoice is automatically sent to the Client by email.

5. Client Obligations

5.1 Commitments

The Client undertakes to comply with these General Terms and Conditions of Sale and, as such, must:

  • Provide accurate, complete, and up-to-date information at the time of registration or order
  • Pay the training fees by the agreed deadlines
  • Inform Erosophia.eu of any changes to the information provided
  • Immediately notify Erosophia.eu in case of loss or unauthorized use of their personal account. Access is automatically terminated upon the expiration of the subscription; no content may be stored or downloaded.
  • Generally, refrain from any behavior that may harm the interests of Erosophia.eu

5.2 Breaches

Without prejudice to any claim for damages, Erosophia.eu reserves the right to suspend the Client's access to training and/or to terminate these General Terms and Conditions of Sale by operation of law in the event of:

  • Non-compliance with these GTCS
  • Infringement of the intellectual property rights of Erosophia.eu and/or its partners
  • Multiple logins by the same Client to a training
  • Providing false information at registration
  • Non-payment, in whole or in part, of the training fee
  • Behavior that harms the commercial interests of Erosophia.eu

6. Right of Withdrawal and Waiver

In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal does not apply to contracts for the supply of digital content not provided on a tangible medium. The Client may cancel their subscription at any time via their personal interface; to avoid renewal, cancellation must occur at least 24 hours before the renewal date.

By accepting these GTCS and immediately accessing the content provided by Erosophia.eu, the Client expressly acknowledges:

  • Having been informed that access to the service begins immediately after validation
  • Giving their prior and express consent for the service to begin before the expiry of the legal 14-day withdrawal period
  • Expressly waiving their right of withdrawal of fourteen (14) days

Consequently, no withdrawal or refund will be possible once access to the content has been activated.

7. Limitation of Liability

7.1 Devices and Browsers

The Client is solely responsible for the configuration of their equipment. They agree to use up-to-date equipment and a modern browser (Google Chrome or Mozilla Firefox recommended).

7.2 Damages

Erosophia.eu cannot be held liable for:

  • Direct or indirect damages caused to the Client's equipment
  • Indirect damages such as the loss of a professional opportunity, a job, or an exam score

7.3 External Links

The Erosophia.eu website may contain hyperlinks. Erosophia.eu disclaims any responsibility for the content or services accessible on these external sites.

8. Force Majeure

Erosophia.eu cannot be held liable for any failure or delay resulting from a case of force majeure, as defined by Article 1218 of the French Civil Code.

9. Accessibility

Erosophia.eu makes every effort to ensure access 24/7, but cannot guarantee permanent availability free from technical interruptions or maintenance.

10. Warranty

10.1 Legal Warranty of Conformity

In accordance with French Law, Erosophia.eu provides the legal warranty of conformity for digital content. The Client is entitled to request the conformity of the Services accessible under their subscription according to legal conditions.

10.2 Limitation

Descriptions of the content are provided for information purposes only. Erosophia.eu does not warrant that the information is always exhaustive or updated in real-time, although it makes reasonable efforts to keep it current.

11. Intellectual Property

Erosophia.eu holds the rights to all elements (texts, images, logos). The Client is granted only a personal, non-exclusive, and non-transferable right of access. Any reproduction is strictly prohibited.

12. Personal Data

Erosophia.eu processes Client Data in accordance with the GDPR for contract management and prospecting. Rights of access, rectification, and erasure may be exercised via contact@erosophia.eu.

13. Complaints – Mediation

In the event of any difficulty, dispute, or complaint, the Client is invited to contact Erosophia.eu Customer Service to seek an amicable solution:

If your written complaint (stating the date, facts, and your request) remains unresolved, you may refer the matter to the Consumer Mediator if the response is unsatisfactory or if you have not received a reply within two months of sending your complaint.

In accordance with Articles L.616-1 and R.616-1 of the French Consumer Code, Erosophia has implemented a consumer mediation scheme. The appointed mediation entity is:

14. Governing Law

These General Terms and Conditions of Sale are governed by French law.

15. Miscellaneous

15.1 Language

The French version shall prevail. Erosophia.eu's computer records and connection logs shall be considered proof of communications, orders, and payments between the parties.

15.2 Amendments to the General Terms and Conditions of Sale

Erosophia.eu reserves the right to modify the GTCS at any time. Existing contracts remain governed by the version applicable at the time of subscription until the end of the paid period.

15.3 Severability

If any clause is found to be invalid, the remaining provisions shall remain fully valid and enforceable.

15.4 Waiver

Failure by Erosophia.eu to act in response to a breach shall not be considered a waiver of its rights to enforce them at a later date.
